GED Prep with Syd™ Terms and Conditions
WHEN YOU PURCHASE GED PREP WITH SYD™ FROM GED TESTING SERVICE LLC ("GEDTS"), THE FOLLOWING TERMS AND CONDITIONS APPLY ("TERMS"):
GED Testing Service LLC (“GEDTS”) provides you access to the GED.com website, applications, products, and services delivered through your browser or mobile app. We use AI tools in our products and services. While your user account on GED.com may continue for an indefinite period of time during which you may enroll or purchase GEDTS’ products, your access to the specific Program is provided on a subscription (“Subscription”), or for a fixed access period (“Access Period”).
By clicking “I accept” or “I agree” or by accessing GED Prep with Syd™ (“the Program”), you (a) represent that you have read and understood these Terms and Conditions, (b) agree to use the Program in accordance with these Terms and Conditions, (c) agree to be bound by these Terms and Conditions, (d) agree to comply with all applicable laws, regulations, and any applicable policies or agreements governing your use of GEDTS products and services, and (e) confirm you are an authorized user. If you do not agree to these Terms and Conditions, or you are not an authorized user, do not use the Program.
The fee for GED Prep with Syd is non-refundable after you access any portion of the Program content, or 30 days from the date of purchase, whichever occurs first.
After you purchase Math Prep with Syd, you will be able to access the Program via your home page on GED.com. GEDTS is not responsible for delays in receipt of access instructions caused by invalid email addresses, spam filters, disabled email accounts, unattended email accounts, technical issues outside of GEDTS's reasonable control, or failure to complete required account setup steps.
Math Prep with Syd is designed to help learners build mathematical knowledge and skills in preparation for the GED® Mathematical Reasoning test. Individual results will vary based on factors including prior knowledge, engagement with the program, study habits, and time devoted to learning. GEDTS does not guarantee any specific score, educational outcome, credential, or passing result on any examination, including the GED® test.
Math Prep with Syd requires internet access and compatible hardware and software. GEDTS is not responsible for issues related to a user's device compatibility, internet connectivity, or other technical limitations outside of GEDTS's control.
In consideration of the fee paid to GED Testing Service LLC, GED Testing Service LLC grants you a limited, personal, non-transferable, non-exclusive, non-sublicensable license to access and use the Program exclusively for its intended purposes and for non-commercial, personal use only during your Access Period or Subscription. This license does not grant or assign you title or ownership in the Program.
All parts of the Program, including third-party products, and applications – and all Marks displayed on the Program are the exclusive property of GEDTS, its licensors and/or their respective third-party owners and are protected by U.S. and international copyright and other intellectual property laws. All rights not expressly granted in the Terms and Conditions are reserved by GEDTS and its licensors.
For the purposes of the Program you agree: "Materials" means content made available through the Program (including the subject area materials, GED® test prep content, quizzes, tips, questions, answers, and all other content associated with the Program). “Marks” means GEDTS’ or any third party trademarks, service marks, or trade names appearing in or on the Program.
You may not and agree not to:
Redistribute or use any Materials available through the Program, except as permitted above.
Share any questions, solutions, or other Prep content made available through the Program.
Reproduce Materials in bulk or for commercial or institutional use (including in course packs, library reserves, or similar compilations).
Use Materials to train, fine-tune or ground machine-learning or AI systems or conduct text or data mining.
Provide Materials to unauthorized users.
Cache or archive Materials.
Remove or alter proprietary notices.
For clarity, these restrictions apply regardless of whether a user believes such use constitutes “fair use.”
GEDTS reserves all rights to use its works, content, and data (collectively “Works”) for text and data mining (i.e. automated analysis to obtain or generate information), in accordance with Article 4(3) of Directive (EU) 2019/790 or other applicable law, directive or regulation. Use of Works for text and data mining without GEDTS’ express written consent is prohibited to the fullest extent permitted by law.
GEDTS reserves the right, in its sole discretion, to modify, update, replace, suspend, discontinue, or enhance GED Prep with Syd, or any part of it, at any time, and without notice, to improve functionality, security, content quality, learner experience, or program effectiveness.
Certain features of GED Prep with Syd may include automated feedback, adaptive learning pathways, or technology-assisted instructional experiences. These features are intended solely to support learning and should not be relied upon as professional, educational, legal, or testing advice.
Artificial Intelligence Notice. Artificial intelligence may be used in delivering certain features and content within the Program. As with any AI, the outputs may contain errors, inaccuracies, or omissions. You should independently review and verify all such outputs before relying on them. Do not enter, upload, or otherwise provide any personal, confidential, sensitive, or proprietary information when using the Program.
GEDTS reserves the right to cancel, suspend, restrict, or terminate access to GED Prep with Syd if any fraud, misuse, technical failure, unauthorized access, intellectual property violation, or other factor impairs the integrity or proper functioning of the Program. GEDTS further reserves the right to suspend or terminate access for users who violate these Terms, engage in abusive, threatening, harassing, or disruptive conduct toward GEDTS personnel, or misuse the Program in any way.
You agree not to copy, reproduce, distribute, sell, publish, modify, create derivative works from, publicly display, publicly perform, share, or otherwise exploit any portion of GED Prep with Syd, including its instructional materials, videos, assessments, questions, explanations, graphics, software, or other content, except as expressly permitted by GEDTS in writing.
You are also required to agree to and comply with all applicable end-user license agreements, platform terms, testing policies, and other agreements governing products or services provided through GEDTS.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
(1) (a) YOUR USE OF THE PROGRAM IS AT YOUR OWN RISK; (b) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS; AND (c) GEDTS AND ITS LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. (2) NEITHER GEDTS NOR ITS LICENSORS MAKE ANY WARRANTY THAT: (a) THE PROGRAM WILL MEET YOUR REQUIREMENTS; (b) THE PROGRAM WILL BE UNINTERRUPTED, AVAILABLE FOR ANY LENGTH OF TIME, SECURE, OR ERROR-FREE; (c) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PROGRAM WILL BE ACCURATE OR RELIABLE; (d) THE QUALITY OF THE PROGRAM WILL MEET YOUR EXPECTATIONS; OR (e) ANY ERRORS OR DEFECTS IN THE PROGRAM WILL BE CORRECTED.
NOTHING IN THESE TERMS AND CONDITIONS ARE INTENDED TO EXCLUDE OR LIMIT ANY CONDITION, WARRANTY, RIGHT, OR LIABILITY THAT MAY NOT BE LAWFULLY EXCLUDED OR LIMITED UNDER APPLICABLE LAW. ACCORDINGLY, ONLY THE LIMITATIONS THAT ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU.
IN NO EVENT SHALL PEARSON OR ITS EMPLOYEES, AGENTS, LICENSORS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE OF DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (a) THE LOSS OF DATA AND/OR THE USE OF OR INABILITY TO USE THE SERVICES; (b) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICES; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (d) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES; or (e) ANY OTHER MATTER RELATING TO THE SERVICES. PEARSON'S MAXIMUM AGGREGATE LIABILITY IN CONNECTION WITH THE SERVICES WILL IN NO EVENT EXCEED THE TOTAL FEES PAID BY YOU FOR THE SPECIFIC SERVICES FROM WHICH THE LOSS ARISES. THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT, OR OTHERWISE, OR IF ANY OF THE LIMITED REMEDIES IN THESE TERMS AND CONDITIONS FAIL THEIR ESSENTIAL PURPOSE.
These Terms and Conditions and any dispute, claim or controversy arising from or relating to your use of the Services (each a "Claim") shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles, and shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods.
